Abstract

This paper discusses the effect of the registrability of rights outlined in Book IX titled “Public Registries” which belongs to the Peruvian Civil Code of 1984. Firstly, the humanistic nature of the aforementioned code is highlighted to understand the importance of subjective rights as part of the coexisting human being’s heritage for the development of their life project. Secondly, the opposability in the Peruvian Civil Code of 1984 is reviewed, specifically in Book IX corresponding to Public Registries. Thirdly, the description of the rule of opposability is made in the fields of subjective law, contract, and registry to establish the consequences of registral opposability. Fourthly, the characteristics that the registral third party must have for the registral opposability of their right to unfold are described. Finally, the conclusions resulting from the discussed topics are drafted.
