The compensatory pension and its current situation: jurisprudential issues

Abstract

The present  work  supposes an updated vision of the jurisprudence and  the  doctrine on  the  compensatory pension. Thus, after  the  reform  of  July  1, 2005,  the  compensatory pension was  configured by  its  temporary, dispositive and rebalancing nature, having to  prove  that,  as  a result  of  the  separation or divorce, there is an economic worsening in one of the spouses in relationship with the other.
