Abstract

On  November 28th,   2018,   the  Supreme Court  issued a  Plenary ruling  confirming a consolidated doctrine in  relation  to  interest  for  late  payment, recently  endorsed by  the  Court  of  Justice of  the  European Union in  its  ruling  of August 7, 2018.  This  paper  will  analyze  the  jurisprudence and  doctrine of the  Supreme Court  established in  relation  to  this  type  of interest, and  will  also  examine critically  the provisions contained in the Act 5/2019, of March  15th,  regulating  real estate  credit  agreements, that  does  not  comply with this  jurisprudential criterion.
