Abstract

The name and surnames make the identity of the people. The first surname that is imposed on babies at birth is usually the most used in academic and social relations, and for this reason the order of the surname that will be imposed — of the father or the mother — can be a considerable importance.

In this article we will analyze the current regulations of the Civil Registry in matters of filiation, favoring our order in the equality of parents when choosing which surname should go first, reminding the agreement using any tool that allows the choice without discrimination, thus avoiding that a third party, such as the Civil Registry Officer, chooses for them.

We will also analyze how the granting of marriage capitulations can be useful to resolve this matter for the future. This work does not seek to be on favor of the establishment of one surname over the other, but both parents, on an equal footing, have the same right to fix theirs after a frank and sincere dialogue.

The fact that the statistics do not yet reflect a radical change in the establishment of the maternal surname does not mean that the subject should be known in all areas and not perpetuate by custom a prevalence that does not conform to our legal system.

Equality is one of the indispensable foundations of our Constitution, so all processes aimed at achieving real equality between the sexes must be applauded.
