Abstract

The control of material transparency linked to the clauses referring to the main object of the contract —developed by the jurisprudence so far-is regulated by the Draft Law on real estate credit agreements. The change of the political context while being negotiated makes the analysis of the amendments proposed to this text highly interesting. Therefore, after explaining the basic rules on the control of material transparency and its use by the courts, the main amendments to the mentioned Draft Law will be examined and evaluated.
