Abstract

The  recent  decision of the  Direción  General  de los Registros y del Notariado of February  16,  2018,  returns to pronounce on  a topic  that  has  had  its stages of jurisprudential variation: the possibility of establishing maximum limits of mortgage  coverage of 5 years, independently or not to cover default and remuneration interests. That  is to say,  if the  limit of the  114  LH  of 5 years of interest  secured  by a mortgage  is common to both  types  of interest, or it should be understood that  a maximum of 5 years of moratoriums and 5 years of remuneration can be guaranteed. We dedicate  these  paper  to review  the  jurisprudential doctrine existing around this problem, and  the  solution offered  by the  Dirección General  in  this  regard.
