Abstract

In  order  to  ensure  the  greatest  transparency in  the  administrative procedures for  the  development of urban planning instruments,  the  legislator  has been  introducing a variety  of measures among which, due  to its  relevance  in  order to maintain the  validity of the  final  act of Approval, special  importance is given  to the proper identification of the real estate owners and real rights holders  benefited by such instruments as provided in article  70 ter.3 of Law  7/1985, of April 2, Regulating  the  Bases  of Local  Regime, measure whose current scope  is partly  clarified  by a jurisprudence that  has  progressively defined  the  type  of instruments affected,  the type of alteration of planning to which it applies,  the  terms  of its preparation from the  information provided by the  Land  Registry  and,  finally,  the  terms  and  form  of their  incorporation into  the  documentation of the  planning.
