Abstract

The multicurrency mortgage,  has  returned to be object  of two  judgments, one of the Tribunal Supremo that  gathers the doctrine of the second one, of the European Court  of Justice, in relation  to the mechanisms of transparency and  duties of information that  must be applied  on her, because  this  mortgage  loan  is difficult to understand for a common consumer —debtor—, who  cannot manage to understand due  the  risks  that  the same  ones  suppose. We analyze  in  this  paper  the  peculiarities and  risks  of  the  above  mentioned mortgage  and  the  juriprudential interpretation brings  over of the  nature of this  clause  in  order to determine the  scope in  the  same ones of the control  of transparency and the duties of information on her; approaching equally which is to our judgment the content and  nature of this  duty  of information.
