Abstract

In a fertility  treatment the medical error is made  of the fertilization of the patient with sperm  not  coming from  her sentimental partner  with clear con- tractual breach  of the clinic  due  to her negligent  act in the control  of identification and traceability of the reproductive material as it is an obligation of result.  Granting compensation for  material and  moral damages in  the  case  of  children and  moral damages inflicted on  the  mother.
