Abstract

Fiduciary businesses in  their  cum amico slope  are based  on  trust deposited between trustor and  trustee,  consisting of a formal  and  apparent transfer of ownership to third  parties,  but  maintaining the real property  the trustor. This  type of business finds  its  maximum diffusion in  the  orbit  of the  familiar relations, and its maximum unrest occurs  when marital crisis  happen. In this  work,  the doctrinal positioning before the negotiating institute is first tackled.  Given  the lack of virtual- ity  conferred  by  the  majority doctrine, the  jurisprudential study will  focus  on  the conceptualization, scope  and  consequences of the cum amico fiduciary business in legal traffic  and  the  study and  commentary of  various judicial decisions that  ap- proach  the  fiduciary business cum amico to the  marital crisis,  both  to distinguish fiduciary businesses from  donations, and  to casuistic study of the  institution.
