Curator: A support for the person with partial modification of the capacity

Abstract

The  guardianship is  a flexible  measure of  support of  the  person partially  incapacitated for the  accomplishment of those  acts  that  are determined in the own  sentence of incapacitation. Persons under  guardianship are limited in ability. The  judge  is who  in  each  specific  case  determines the  support of the  guardianship that  the  partially  disabled  needs.  After  the  evaluation of the  evidence the  judge  ac-credits  the  disease  and  the  current situation of  abnormality in  daily  life  and  real risk  of the  disabled.  It  is a legal institution favorable  to their  interest.
