Abstract

This paper analyses the legal effects and remedies following the early termination by a tenant of a lease agreement of urban real estate properties, either under the Urban Real Estate Acts of 1994 and 1964. The analysis differentiates between residential and commercial lease agreements, which are subject to different legal treatments, and between the contracts includ- ing a penalty clause —which is typical in commercial lease agreements— and those which do not. The specific aspects for commercial lease agreements in Shopping Centers are tackled in the last sections of this paper.
