Abstract

This paper analize the control of general clauses regulation, particularly about floor clauses, in the business to business loans. Based on an analysis of the doctrine of the Supreme Court contained especially in the sentences of the 3rd June 2016 and the 9th may 2013, this is a study about the scope the good faith principie as criterion and limit of the general conditions in the contract, trying to come up with a general solution that protects all adherent (consumers or businessmen) with respect to this kind of clauses.
