Abstract

As a result of the real state bubble in our country the number of mortgages had increased exponentially. Subsequently, the economic crisis resulted in the opening of thousands of legal proceedings in mortgage matter, which was compounded by the existence of practices and unfair terms on hiring mortgage loans. In this article the possibility of solving many of the controversies generated in the span of mortgage loans going to the institution of arbitration arises. The kind of mortgage loans which would apply arbitration are suggested, which disputes could be resolved including the characteristics and its advantages over traditional judicial settlement of such conflicts.
