Abstract

This paper analyses the problems concerning the sale of homes under construction, its legal nature, the guarantees required before the purchase of the house and the jurisprudence sitting in this area with special reference to the Sentence of 21 December 2015 which says that in the sale of homes under, the banks are liable for repayment of amounts paid on account by buyers, if the house does not get to build or deliver in legal term and the developer has not guaranteed or insured these amounts.
