Abstract

The duty to pre contract information and the real understanding by the debtor in a loan agreement with a consumer is one of the pillars on which to base the granting of responsible lending. Only if the debtor knows the extent of the implications and economic burden that the loan will mean for him, he will know if he is willing to consent to it, assuming the obligations agreed to return.

This duty of disclosure is based on the proven transparency of the terms of the loan agreement, making them understandable. Well, in this paper we analyze, the control work transparency can and should carry out the registrars, in a mortgage loan contract with a consumer debtor. The effective and efficient control of transparency becomes a powerful tool for understanding the debtor product, and ultimately contributes to the voluntary assumption and certainly a responsible part in the loan corresponding to the debtor.
