Abstract

The Spanish Bankruptcy Law does not exclude the possibility to rescind an operation regarding a structural modification within the bankruptcy proceeding. However, this issue has sparked a wide debate that has taken place within the Academia and also within the wording of Spanish court decisions. These operations have been considered mostly as unassailable under the rule that is in force under Spanish Corporate Law.
