Abstract

In zoning, the benefits and burdens assigned to each unit should be distributed fairly. When planning instruments define complex management processes that traditional development systems fail to foresee, however, development systems may not anticipate how to solve all the fair distribution problems that arise, and urban planning legislation is not thorough enough to do a proper job of guiding the implementation of modern, complicated planning instruments. As a result, the authorities may sometimes be forced to use formulas under alternative management schemes allowed by the law. Reasonably speaking, registration of such formulas should not be withheld. Proper coordination is required so that these formulas can be registered according to a procedure that provides disclosure and legal and in-rem effects and at all events preserves full respect for the rights of the registered owner.
