Abstract

This paper takes a critical look at the structure of the personal property registration system. The system ought to be organized based on the objects registered, not the rights in such objects. Not everything registered in the system is property, nor is all the property registered in the system personal property. It seems strange that clauses of general terms and conditions should be eligible for registration in the personal property registration system. Where interests in private limited companies are concerned, the legal nature of the interests becomes an issue.
