Abstract

Certain legal situations not registrable in the property transactions also require protection Land Registry. For such purposes often the figure of the notation used. Without this particular seat the effects of the principle of public faith registration would roughing and generate distrust in the system of real property transactions. Its regulation provides the registration procedure of a functional and practical element that allows rebut the irrebuttable presumption in favor of the mortgage third, whose unassailable position can overturn the practice of the seat. Its preventive role ago becomes a necessary tool for the development of real estate legal traffic. Therefore, in different seats registry systems exist whose function is to rebut the public faith registration, which is known as negative effects of advertising. In Cuba the courts have directed the look of this unique seat whose practice begins to be felt after half a century of absence. However, the requirements of property transactions in our country demand a reformulation rules to provide greater legal certainty.
