Abstract

The existence of a special foreclosure procedures is what it makes fully efficient the mortgage in Spain, since to proceed with the forced sale of mortgaged property a declaratory judgment is not required but is passed directly to the enforced collection procedure based on rapid steps, with very limited opposition causes. Based on the prerequisites established by law for the application of the special foreclosure procedures, in this paper the requirements are studied so that documents that are collected the award that culminates the foreclose can have access to the land registry. So these demands are analyzed from the perspective of the different aspects that the Property Registrar must qualify.
