LEASE AGREEMENTS SUBJECT TO DECREE 100/1986, OF 22 OCTOBER, MADRID COMMUNITY AND SALE OF PROMOTIONS PROPERTY: A REVIEW DOCTRINE, JURISPRUDENCE & LAW

Abstract

In this investigation we analyze if leasing contracts involved, referring to Decree 100/1986 of 22 October, regulating the assignment lease of housing units of Public Promotion (and date before the law 29/1994, of 24 November, of Urban Leases) on housing developments without public protection rating, can be understood as undefined in terms of duration. Regardless of contractual breaches by either of the parts and the preexistence of legal authorization to dispose of the referred promotions.
