Abstract

This article addresses a very thorny issue in legal practice, testamentary invalidity stemming from an elderly person’s difficulty or inability to express his or her last will due to a lessening of capacity or complete loss of capacity. The importance and timeliness of the issue justify greater study in a society with a growing elderly population.
