Abstract

To adapt to international requirements, the Spanish Civil Code has eliminated parents' authority to administer reasonable moderate correction to their children. The express elimination of this authority from the law poses several legal and practical controversies, such as the appropriate classification under criminal law of given types of corrective action administered for educational purposes and, at all events, the degree of intensity that suffices in order for corrective action to be regarded as a felony or misdemeanour under the Penal Code.
