Abstract

If Argentina's business legislation is to be updated, it is going to be necessary to follow the postulates of certain guiding ideas or principles. It should not be a matter of modernizing legislation at any price. No, one of the objectives ought to be for business legislation to be updated so that it is effective and observes the «rules» real business uses. To do so, lawmakers should use simple language, and they should attend first of all to those sectors of trade that are clamouring for new laws and clearer ones. Yet lawmakers must never forget that all new legislation must respect the directives of the National Constitution, which erects the pillars on which the new, more modern Argentinean economic and social order must be built. In short, account must be taken of these necessary bases or premises that will ensure the legal force and effectiveness of the updated Argentinean business law.
