Abstract

Under Act 30/2007 of 30 October on public sector contracts, juristic acts involving immovable property are excluded from legislation on public sector juristic acts. That is a major modification. What rules do apply are still not entirely clear to this day. There are contradictory opinions and decisions from administrative contracting advisory boards. Because of the ever-increasing weight of private law in public sector contracts, the problem needs to be considered from the standpoint of civil law, paying special heed to issues concerning contract conclusion and the inclusion of prohibitions against contracting.
