Abstract

The Decision of 14 June 2011 of the Directorate General of Registries and Notarial Affairs identifies planning use as an object of law. This view dates back fundamentally to the 1975 Land Act and its terms concerning developable land, but the first real endorsement of planning use as an object of law came in Act 8/1990 of 25 July, implemented in registration much later in Royal Decree 1093/1997 of 4 July. Royal Decree 1093/1997 dealt with a wide variety of issues; one thing it did was to respond to the technique for what was termed "asystematic actions on urban land" and cases of autonomous configuration pending consolidation on land whose purpose is not yet established. Both legislation and practical reality allow these cases to be expanded, but always under the premise of oversight by the land planning administration.
