Abstract

The avoidable, unbearable sound of a piano violates a neighbour's right to family and personal privacy. Exercise of that right requires that the atmosphere within the home be immune to disturbing aggressions from outside. The resident has no specific duty to bear such aggressions. Pounding, persistent noise may be produced by lawful activities but ceases to be lawful in itself when certain limits are trespassed (as in the case of the piano), at which point the noise is considered an aggression.
