Abstract

This is a review of the interpretative light that legal thought and case law throw upon the issue of how to categorize the period during which a shipper may take action against a forwarding agent under a bill of lading contract. Particular emphasis is given to whether the period is one that may expire or lapse and what the consequences might be regarding interruption, extension, expansion and reduction. Consolidated case law is in favour of expiration, although there are some isolated decisions that say otherwise.
