Abstract

The recent globalization process has favoured the appearance of a new concept of distance contracts that take place in virtual environments opened thanks to the Internet and other associated technologies. In this paper we study the special features of contracts made over the Internet in comparison to traditional contracts, we examine the risks inherent in such contracts and we look at the concept of the Internet contract, legislation concerning Internet contracts and the capacity of the parties to the contract. Starting with the idea that e-contracts are contracts concluded between absent parties, it is a point of interest to ascertain at what point in time and space the contract is understood to be concluded. We look at contract performance and proof thereof, and we discuss electronic signatures, whose basic problem is signature security.
