Abstract

Financial insolvency that persists after a person's death may unleash the phenomenon of post-mortem bankruptcy, where succession law and bankruptcy law mingle. The object of this paper is to examine the influence of post-mortem bankruptcy on Italian bankruptcy legislation through a study of the principal rules concerning the topic, including budgets, time periods, legal standing and effects. The appropriate comparisons with Spanish rules and regulations are then drawn, and, more importantly, some reflections are offered on the autonomy of the hereditary estate and its separation.
