Abstract

This is a commentary on the Directorate- General's decision of 8 July 2010. The decision finds that an acquisition predating a caveat noting a freezing order may be registered even if the acquisition is submitted for registration after the freezing order. But this does not mean the caveat is cancelled. The article regards the self-confessed «eclectic » decision as lawful and underlines the case-law doctrine that provided the basis for the first pronouncement of the decision.
