Abstract

This is a study of how case-law and legal thought deal with one of the most controversial aspects of the substitution of a minor and exemplary substitution (or the substitution of a mentally ill heir, devisee or legatee). In particular, it is a well-known fact that the scope of the assets covered by instructions concerning heirs varies depending on the institutional category used by the testator. In the substitution of heirs or legacies, the object will depend on the means chosen by the decedent when deciding on the disposal of his or her assets. Specifically, despite certain resistance from legal thought and case-law, in the substitution of a minor and in exemplary substitution, the substitute (parent or legal representative) may dispose of all the assets of the person substituted (child under 14 years of age or incapacitated person). Therefore, in theory, both types of substitution affect the entire estate left to the persons substituted.
