Abstract

The current enforcement proceeding on mortgaged property is not a particular procedure but an enforcement proceeding in which there are some peculiarities for the execution of a particular property. This fundamental difference introduced by 1/2000 7th January, Civil Procedure Act, should be sufficient to allow continuing the execution against all assets of the debtor through a single enforcement procedure, but with the specific procedural rules laid down in the Act for the enforcement of the mortgaged property without the creditor having to choose, as has been widely understood, by running first the mortgaged property through the mortgage enforcement proceeding and then the rest of goods; or by directly executing all but renouncing the specific procedural advantages of the mortgage enforcement process.
