Abstract

This paper attempts to explore the conceptual and structural elements ofthe idea of per son who occupies the central position in the current legal system. For this purpose, I make a brief overview of the historical evolution of legal thought with special interest in its obvious con-tradictions changes of concept to focus on the treatment of ability and disability. Referring to disability I study the diffe-rent grades and conditions as well as remedies and solutions prepared by the legal system, with special emphasis on the present moment. Our legal system shows the intellectual efforts to make possible the maintenance of constitutio-nal rights and values of freedom and equality in cases of dysfunction or illness that put people in a position of depen-dency. This focused on its impact on Spanish Legal System in force and the effects on it of the ratification of the Convention in New York December 13, 2006. Therefore, I study separately the personal situations of disability, age and handicapped, as well as legal measures of protection, assistance and representation required in each case.
