Abstract

Section 11 of the Spanish Environ-mental Liability Act of 2007 foresees (non-joint) several liability in situations when more than one tortfeasor can be held liable for the same damage caused to the environment. In doing so, the new rules on liability for environmental damage differfrom the traditional joint and several liability approach that is applied in cases where liability cannot be appor-tioned among the tortfeasors. The paper deals with the impact of the new rules and their p ractical problems in the current Spanish law of torts
