Abstract

The hearing stage of proceedings, as provided for in the Act on the Judicial Review Procedure, is essential. And because it is essential, it must be observed -save where there are overriding reasons for urgent action- in the procedure whereby decisions are taken ordering a caveat issued in warning that disciplinary proceedings have been initiated in connection with land planning. This requirement is justified also by the aggressiveness of the act toward the recipient, given that a caveat order is not a regular part of procedure, but a temporary precautionary measure intended to aid in the principal procedure, and whose final efficacy shields any third-party purchasers who may appear.
