Abstract

The current system of rules concerning legal residence continues to raise problematic issues that have persisted over time and through the diverse laws to which this matter has been subjected. Furthermore, legislative reform of matters connected to or related with legal residence has affected the question of legal residence by modifying or otherwise creating nuances in the rules concerning legal residence. This paper starts with the basic features of the Civil Code's current rules on residence (articles 14 and 15) and brings to the discussion some of the problems that have been and today remain the object of diverse positions in doctrine and different interpretations of case law, such as modification of the legal residence of minors by de facto address and evidence of a person's own legal residence. In addition, the paper analyses the importance that recent reforms of Civil Registry legislation have had for the legal residence of adopted persons. The paper is completed with an analysis of some of the ways of acquiring legal residence (assignment by parents) or modifying legal residence (choice of a minor).
