Abstract

The foundations of liability for damages rest on the rule of fault. However, the evolution of this subject, especially due to the transformation of society, has headed toward different grounds, such that who is charged with liability for damages depends on who creates the risk in a given activity. It is necessary to delimit what type of risk we are talking about and whether each occupational activity is linked with a specific type of risk, outside which it would be appropriate to apply not risk theory but rather the rule of subjective liability based on the fault of the originator.
