Abstract

The evidence shows that the defendant is fully and permanently incapacitated such as to place a functional limit on her capacity to govern herself and to control her property. Setting by the Supreme Court of the rules of interpretation that enable the constitutional system of protection for persons of less than full ability to be reconciled with the New York Convention of 13 December 2006 on the Rights of Persons with Disabilities and the terms of the Civil Code after its 1983 reform.
