Abstract

The legal structure of real-estate complexes in the areas termed «mature tourist destinations» is undergoing a profound crisis of renewal, due to the need for physical renovation and the changing of the generational guard, in terms of both the needs and tastes of the people the tourist product is aimed at and the owners of hotel and other complexes. The registration institution is an element of that change, because the social necessity of publicity about the tourist/ administrative quality of complexes is necessary for real estate trade and for the pertinent measures to be taken by economic and administrative agents. Whether the registration system has got to be the watchdog of the principle of unity of operation and turn down any legal/real changes that disturb that principle and/or whether it has got to be the channel for the necessary modifications of legal structure, purpose and residential or tourism use is the question this paper attempts to raise. Experience in the Canary Islands with regard to the registration system's coordination with the administrative registry of tourism enterprises and the effects of said publicity just might be useful for the other Andalusian, Murcian, Levante, Catalan and Balearic areas with similar laws.
