Interpretation of section 98 of Act 24/2001 of 27 December on fiscal and administrative measures and measures of a social nature and its coordination with section 18 of the Mortgage Act has aroused discussion about the scope of a registrar's scrutiny of a representative's powers for due form. The existing case law on the subject is briefly reviewed, focusing on the most up-todate rulings of provincial appellate courts on appeals against decisions by the Directorate-General of Registries and Notarial Affairs, to try and explore and summarise the very well-known postures toward this affair and our own views on the matter.
