Abstract

Critical analysis of Supreme Court case law on estate partition. A legacy consisting in the property of a conjugal partnership, left by one of the spouses, will be fully effective in connection with the testator's estate. The testator cannot give any orders in connection with the estate of his spouse when there is nothing so establishing in the spouse's will. The efficacy of the rule of partition will depend on whether the property left by the testator was assigned to the testator in the division of the conjugal partnership.
