Abstract

Title insurance has been developed in United States as an alternative system of protection for property rights. No other country has a similar mechanism, but registration systems. Problems are nearly the same in every case, but the way to resolve them is different. The purpose of this paper is to show the title insurance system and its main advantages and disadvantages as far as property rights disclosure and protection are concerned. Extent of coverage and liability for mistakes in the search of title are some of the key issues in this topic. And an interesting idea arises as a conclusion: title insurance companies, which are private companies, are more interested in obtaining profits with their activity than in providing protection in conveyance. Public registries, however, keep their interest in security in land transactions as a general principle.
