Abstract

In this paper the authors analyse the concept of the supplementary title in Nicaragua. A supplementary title is a court's authorisation to have property registered as belonging to a person who shows proof of ownership (not possession) where there is no third-party opposition. It is a proceeding carried out before a judge, filed by a property owner who has no title or whose title cannot be registered because of irremediable flaws. Supplementary titles facilitate access to registration for property and the fight against clandestine transactions. The authors, however, criticise how in Nicaragua supplementary titles are being abused and used fraudulently to produce the opposite of the intended effect, and they advocate the future abolition of supplementary titles.
