Abstract

Act 41/2007 reforming the mortgage market amended article 54 of the Act on the Chattel Mortgage and Pledge Without Bailment, making a place for pledges of rights without bailment. This is a new figure that was discussed by the Directorate-General of Registries and Notarial Affairs' Decision of 18 March 2008 in reply to two private inquiries about the coexistence of the new pledge without bailment on credits and the traditional possessory pledge.
