Abstract

Act 41/2007 has introduced into our legislation terms regulating the floating mortgage, using, what is more, for the first time the expression «hipoteca de máximo» (literally, «maximum-sum mortgage ») to refer to it. This paper analyses the characteristic notes of the «maximum- sum mortgage» and the floating mortgage, as well as the doctrinal, jurisprudential and practical situation concerning this latter concept that existed prior to Act 41/2007, in order to compare it with the terms provided for in the new article 153 bis of the Mortgage Act.
