Abstract

This paper analyses article 25.1 of the Urban Leasing Act in regard to the Decision of the Directorate-General of Registries and Notarial Affairs of 10 December 2007. The Decision establishes that the tenant has the right of first refusal only where the sale of the leased housing is concerned, and that said right cannot be extrapolated to cases of gift in payment, whereas the point at issue is a legal limitation of ownership that must be interpreted restrictively.
