Abstract

The liability stemming from a judgement made on grounds that are, to say the least, confused, authorising a minor to donate part of her liver to her own daughter, has thrown the spotlight on a conflictive situation that our legislation has not entirely settled. In this commentary there is a series of reflections about the capacity to give informed consent when the organ donation is made by a living underage donor. The topic's serious implications certainly merit an in-depth study and a reconsideration of the question. Let this serve as a small preview to draw attention to the topic.
