Abstract

Cultural nationalism maintains that cultural objects must be returned to the State from whose territory they have been unlawfully removed. When that State initiates proceedings against the possessor of those cultural objects, the competent courts usually do not enforce foreign rules on the protection of national treasures. However, the Council Directive 93/7/EEC states in article 12 that ownership of cultural objects shall be governed by the law of the requesting Member State.
